Lydia DePillis wrote the Washington City Paper’s cover story on the case for Congress overturning DC’s height limit, which should be very familiar to readers of this blog. It’s got some interesting history in it (DC’s height limit was apparently influenced by George Washington’s personal aesthetics, despite the fact that he never governed from the city), but the part that was really interesting to me was the part where she discusses what the new limitations should be. It’s not politically practical to advocate for lifting the limit without reservations, as we here would like, and there are the usual caveats and equivocations (“What if additional height were granted on a competitive basis, and awarded for the best design?”). But the part that really stood out to me was this graphic (click on the image and scroll to the bottom of the linked page to see a bigger version), outlining where Lydia thinks the height restrictions should be lifted: Anyone familiar with DC geography will notice that the area most insulated from change – Northwest DC – is the richest part of town, full of desirable white neighborhoods. The areas where DePillis advocates lifting the height limit – neighborhoods east of the Anacostia River figure prominently in the graphic – are far blacker and poorer than the rest of DC. Sure, there are pretty buildings in NW and a lot of ugly ones in Anacostia, but there are also beautiful homes off of Benning Road and shitty ones in Burleith. (Which, I should add, could desperately use some taller buildings, given its proximity to the perpetually housing-strapped Georgetown University and its rather ugly architecture compared to Georgetown proper.) 1. Mumbai is rethinking its density bonuses for developers who build parking lots and hand them over free of charge to the city. 2. Tort liability driving away possible MARC operators. 3. San Mateo County legislators threaten to charge San Franciscans a congestion charge similar to the one that the city is proposing to charge San Mateo (and East and North Bay) commuters. Bring it on, I say – it’s about time drivers were charged for using local roads. 4. The Supreme Court refuses to hear West Harlem business owners’ appeal against the city’s decision to use eminent domain to hand Manhattanville over to Columbia University. 5. The NYT has a story about a commercial kitchen-for-rent in Queens, calling it a “lifeline” for for “100 small businesses.” It’s a nonprofit, but even renting a space there for 6.5 hours in the middle of the night costs $154. I’m still waiting for the Times story about the many more people who cook illegally out of their own homes and whose businesses are therefore stunted and precarious, all because they can’t afford to comply with the city’s onerous health and zoning codes. 6. The US may have 1 billion parking spaces. This does not in and of itself prove that we have too much, but for those of us who already believe that zoning codes mandate more parking than the market would provide (for which there is good empirical evidence), it’s a horrifying thought. 7. Yonah Freemark discusses how Hong Kong’s transit agency uses property development to internalize positive transit externalities and maintain (relative) independence from the municipality. 8. The WSJ reports on the strong market for downtown office space, especially compared to declining suburban office parks.

Development blogger Roving Bandit criticizes UN-Habitat executive director Joan Clos for saying that Africa is “confronted with […] the challenge of preventing the formation of new slums.” I wonder if Clos thinks that the Lower East Side was born with yoga studios and Starbucks. 2. A kidney dialysis center in the Chestnut Hill neighborhood of Philadelphia wants to open in an abandoned industrial site, and when the City Council moved to overrule the local residents’ objections to the clinic staying open nine extra hours a week, they sued and called it an attack on democracy. The residents claim to want “peace and quiet,” which I guess you can’t get when you have people whose kidneys are failing all around you. Edit: Commenter Terry Nicol pointed me in the direction of this story earlier this year about a locally-owned Chestnut Hill grocery store that was threatened by a local resident for selling prepared food. 3. Yonah Freemark writes about Dallas’ new and extensive, but underperforming light rail network. Apparently the new lines were built along automobile corridors and bypass the densest parts of town entirely, and so the system functions more as a glorified park-and-ride rather than as an engine for infill growth. 4. Topher Matthews lays out his proposal for “performance parking” (i.e., charging market rates for street parking) in Georgetown. This is desperately needed in this very trendy and congested area – I remember one hairdresser on Wisconsin Ave. telling me about the convoluted game of hide-and-seek she played in order to park for free on the residential streets. Unfortunately, one DC Commissioner apparently believes that, even in one of DC’s most walkable neighborhoods, parking minimums are necessary: “This is an office building. I know I’ve kind of beaten this horse dead, but this environmentalism vs. density stuff just enrages me too much to relegate it to a link list. Here are some excerpts from an article about how the EPA’s proposed new rules for cleaning up the Chesapeake Bay could impede dense, environmentally-friendly development: For decades, the federal Clean Water Act has tried to get communities to reduce the effects of stormwater runoff. Heavy rains often carry fertilizers and soil into streams and rivers — ultimately killing aquatic life in vulnerable bodies like Chesapeake Bay. In response to tightening federal requirements, the state of Maryland is putting together a regulatory system that aims to cut the amount of nitrogen, phosphorus, and sediment flowing into the degraded Bay. But opinion is sharply divided over whether the plan will have a good or bad effect on the character and location of future development. […] In the letter, Potter warned, however, that there are “potential conflicts between the TMDL mandate and Smart Growth” — conflicts that neither the state of Maryland nor the Environmental Protection Agency has adequately addressed. “I believe the WIP will definitely make it harder to do low-density greenfield sprawl,” says a forum organizer, Stuart Sirota, principal of the New Urbanism-oriented TND Planning Group. “But I am concerned that the [state plan] may have the unintended consequence of making it more difficult to do higher-density infill within redevelopment areas and growth areas.” Another forum organizer, Jim Noonan, who in the 1990s helped implement Governor Parris Glendening’s original smart growth program, agrees with Sirota that the Maryland plan may hinder dense, walkable, transit-served development — the kind of development that meets smart growth objectives. New York City 1. A while ago I wrote about how Manhattanville’s blight, and therefore Columbia’s ability to use eminent domain, was the fault of bad zoning. The nearby neighborhood of West Harlem looks like it’s learned that lesson, and is seeking to protect itself against encroachment from Columbia by upzoning itself. Unfortunately it’s not a pure upzoning – there’re also affordable housing mandates, regulations against “sliver buildings,” and some unspecified protections for existing structures. The massive 100-block rezoning is the first in half a century. 2. A handful of buildings in Downtown Brooklyn may get historic district’d. 3. A massive parking garage in Jamaica, Queens is receiving huge tax breaks, ostensibly for reducing congestion. Why am I not surprised to see that it’s owned by an organization with “development corporation” in its name? 4. Janette Sadik-Khan wants to expand the “pop-up cafe” program that essentially lets businesses use parking spaces as seating areas. I personally think that anyone who’s willing to pay more than the current metered parking rates should be allowed to do whatever they want with the space. Washington, DC 1. Security expert Bruce Schneier suggests closing the Washington Monument “as a monument to our fears,” and Matt Yglesias wants terrorists to blow it up – something I’ve suggested before. Maybe if that boring obelisk were gone, people would give up on DC’s height restriction and consider turning the Mall into a place that’s actually pleasant to be. 2. Why the Washington City Paper chose to bury that behind items about “neighborhood branding” and “supporting the enactment of pending federal legislation to ensure that insurance reserves are held and invested in the U.S.” is beyond me. 2. DC has, unfortunately, also started to cap the number of cabs in the city. American politicians just can’t get enough of screwing over Somalis, I guess. 3. Jamaica, Queens gets downzoned. The Post tells us joyfully that the city is implementing the “innovative and critically important” FRESH initiative to deal with the area’s lack of supermarkets – which will be sorely needed now that the city is guaranteeing that there will be no new demand for food. 4. “Vertical parking lot” in Chicago, circa 1930. 5. David Alpert at GGW asks us what we think about the up-and-coming DC neighborhood of NoMa and its lack of parks: And in the future, all cities and towns should avoid making the same mistake. Libertarian-leaning urbanists like Market Urbanism have recommended fewer development restrictions and greater reliance on the free market. In many cases that makes a lot of sense, but the NoMA experience shows a need for at least some mechanism to reserve for public goods some of the value an upzoning generates. Is there a more free market way to handle this? I have a few thoughts about this. The first is that, to some extent, David answers his own question: developers have to fill every inch of space because of DC’s height restrictions. Lift the restrictions, and I think you’d see some more experimentation with taller towers and more green space. But secondly, I’m not sure that I exactly agree that parks that take up large amounts of space are really the answer here. DC is the perfect example of a city with too many parks in all the wrong places – the Mall is a barren wasteland, and even a lot of the more rationally-placed parks are essentially expensive homeless shelters, but without the shelter part. I know that here in Philadelphia, at the corner of 40th and Market, there’s a park-like open space on the edge of a public housing project, and despite the large amount of foot traffic, El station, and bus stop, I have yet to see a single person in the park – people seem to prefer to hang out on the corner. This is probably my favorite link list yet…enjoy! 1. The WSJ claims that delinquent homeowners can expect to stay in their homes after making their last mortgage payment – that is, they can live rent-free – for at least 16 months. The longer it takes for foreclosures to happen, the longer it will take for real estate markets to adjust to the new paradigm. 2. Fascinating article about food trucks in Houston. In it I found a second example of bad anti-terrorism policy trumping good urbanism: Chimed in Joyce: “We all know that Houston is not a walking city, as much as we wish it was. But there are two areas that are walkable – downtown and the Medical Center. The use of propane trucks is prohibited downtown, however. The regulation was originally put in place as a part of Homeland Security after 9/11, but the Houston Fire Department continues to enforce it. That’s an example of something we’re looking to work with, to allow food trucks to operate in these higher foot traffic areas.” The article also confirms my suspicion that food trucks may actually be safer than restaurants: “These are essentially open kitchens…you can look in there and see exactly what these guys are doing, where they’re grabbing the food from, how they’re cooking it.” 3. Hong Kong and Singapore are both instituting controls on their residential property markets to avoid bubbles, but they are also freeing government land for developers (in spite of Singapore’s free market reputation, most residents apparently live in public housing). Some speculate that Hong Kong’s controls might be a sign of increasing control from Beijing. Reuters says that “China, Singapore, Taiwan, Thailand and Malaysia have also unveiled more stringent regulations in recent months” – the bubble that led to the 1997 financial crisis […]
Last month, Eric Fidler of Greater Greater Washington left a tantalizing comment suggesting that DC was going to do away with its minimum parking requirements soon. Obviously this would be very big news and a welcome change for market urbanists, and it looks like it might indeed pan out. On Monday the Zoning Commission is taking comments, but the DC Office of Planning’s draft is apparently very promising. The documents themselves are, like all planning documents, quite long and bury all the dirt within a morass of bullet-points. While I read over the first dozen or so pages, my eyes soon glazed over and so I’ll be relying on GGW’s summary. So, to start out with, here’s the good news: Parking minimums would disappear in most cases. In neighborhood commercial corridors or low-density residential areas without good transit, commercial, institutional, or multi-family residential buildings would still need to provide some parking. But any area with good transit service, or high-density areas, would have no requirements. Beyond that, however, the plan falls short of the market urbanist ideal. To misquote the internet meme, “planners gonna plan” – not content to simply dismantle the previous density-forbidden regimes, the planners are trying to stay relevant by instituting a few density-forcing rules. Parking maximums would come into effect (total lot size, for example, would be capped at 500 or 1000 spaces), and new parking lots wouldn’t be allowed adjacent to sidewalks, a reversal of the traditional setback requirements which encourage the parking-in-front designs so common in America. And while I’m sure in many of these cases the maximums will be set higher than people want to build anyway, GGW points out at least a few proposed projects that would have too much parking under the guidelines. With the District of Columbia’s height restriction entering its 100th year, Lydia DePillis from the Washington City Paper explains why downtown DC is all superblocks with so little natural light: While reading about the new Safeway-anchored residential development just approved in Wheaton, all I could think was: Why can’t we get these kinds of buildings in the District? It’s a 17-story, 486-unit, 195-foot-tall apartment complex that will add density and vibrance to the suburb’s delightfully diverse and quirky town center. But it won’t look like the superblocks that proliferate within the D.C. diamond, which are the way they are because developers must ask their architects to pack as much square footage under the 130-foot height limit as possible to make the deal work financially. Since Wheaton is not bound by such restrictions, this development can achieve a kind of light, airy quality with towers on each corner and quite a bit of open space in the middle of the block. That also creates higher-quality living spaces for apartment dwellers, many more of whom will be able to have natural light. The NYT also points out that “[b]ecause they cannot build up, developers have pushed out, helping gentrify less affluent parts of the city.” And as I’ve noted before, Matt Yglesias has blamed DC’s higher-than-Manhattan office rents on the height cap. Confusingly enough, the height restriction is enshrined in federal law and is thus in Congress’ hands – so the question is, do legislators just not give a shit because none of them are elected by DC residents, or do they actually have an active interest in the status quo?
