It’s no secret that conservatives and libertarians don’t have very warm feelings towards urbanism. But with their emphasis on upzoning and reducing parking minimums, shouldn’t new urbanism and smart growth have at least some libertarian constituency? And given that local roads are paid for almost entirely out of general funds – that is to say, local roads are a blatant example of socialist redistribution – you’d think that there would be people on the free market right advocating raising the gas tax and tolling highways. But alas, no such luck. Michele Bachmann thinks roads shouldn’t count as earmarks, Carl Paladino’s never met a road he didn’t want to detoll, and Mother Jones managed to cobble together a whole article’s full of “We don’t need none of that smart growth communism”-style rhetoric coming from the Tea Party. Now, it could just be that there are just too many suburban Republican voters whose homes, lives, and culture are invested in sprawl for any politician to oppose it. But that doesn’t explain the lack of support from libertarian think-tanks and magazines, who, by virtue of their complete lack of political viability, don’t have to worry about politics and getting re-elected in the suburbs. Cato and the Reason Foundation still toe the “war on drivers” line, with Randal O’Toole denying that any developers even want to build less parking than current minimums require. So why don’t conservatives and libertarians have more compunction about sprawl? I believe the problem is more the messengers than the message. A lot of fuss has been made by urbanists about how important the ARC transit tunnel under the Hudson is to curbing sprawl in North Jersey, but frankly I’m not convinced that more commuter rail into Manhattan is the cure for what ails New Jersey. The state’s fundamental problem is its reliance on two cities outside its borders for providing jobs to its people, and it’s used the existence of New York and Philadelphia as excuses to remain a sprawled, suburban oasis in the middle of a dense Northeast Corridor, which can’t continue once it runs out of land and money. Commuter rail in post-WWII America has never quite lived up to transit activists’ hopes, and the NJ Transit service and the ARC tunnel will be no different. Instead of viewing suburban train stations as smaller versions of city stations, locals like to think of them as their own personal portals into downtown business districts. Suburbanites don’t want transit-oriented development – they want lots of parking so they have access to the station, since most of them don’t live within walking distance. Increased density and less parking might benefit future residents who would move in to new developments, but they don’t show up to zoning board meetings and don’t get a vote. As an example of how many towns waste their transit, I grew up in Bryn Mawr, a suburb of Philadelphia, and a town which has better transit access than the Upper East Side. It’s part of a string of towns collectively known as the “Main Line,” after the train tracks that run through the area, there’s a light rail line that runs south of the main commuter line, and there are a few bus lines (both SEPTA buses and private college shuttles) that connect the towns. by Stephen Smith New Jersey has always been an odd state – it’s the most densely populated of the fifty, and yet it lies just outside of the core of both of its metro areas (Philadelphia and New York). North Jersey does have a formidable number of mid-sized cities, but the biggest – Newark – is a posterchild for urban neglect, and New Jersey’s urban areas play a tepid second fiddle to their much larger counterparts across the Delaware and the Hudson. New Jersey’s appeal lies undeniably in its suburbs, which are connected by a network of government-built roads and enabled by anti-density development rules. Despite New Jersey’s predilection for sprawl, the New York Times reports that the state may literally be running out of horizontal space. A Rutgers study claims that around the middle of the 21st century New Jersey will become the first state to develop all its unprotected land development trends remain unchanged. The NYT article then claims that denser redevelopment is on the rise and cites a few of anecdotes as evidence, but frankly I’m not convinced that the state is very reform-minded when it comes to its density-limiting regulations. Even among the examples given by the Times we see the limits of reform: a 217-unit luxury rental apartment building near the Morristown NJ Transit station – an area that was supposedly rezoned as a “Transit Village Core” a decade ago – was only allowed to go forward after the developer agreed to build 722 new parking spaces. On a more general level, New Jersey’s experiment with zoning reform in the ’70s and ’80s has been severely disappointing in terms of liberalization. by Stephen Smith Although we at Market Urbanism are big fans of Donald Shoup’s work on parking minimums, we have to admit that rigorous econometric evidence that parking minimums mandate more parking than the market would otherwise supply has been a bit lacking. Randal O’Toole at The Antiplanner quite rightly asks to see empirical proof that parking minimums are binding. Tyler Cowen appears to have found this proof, in the form of paper posted online very recently which seeks to determine whether or not non-residential developers in Los Angeles County build more parking than they would in the absence of minimum parking mandates. Here’s the second half of the abstract, emphasis mine: [To] our knowledge the existing literature does not test the effect of parking minimums on the amount of lot space devoted to parking beyond a few case studies. This paper tests the hypothesis that parking space requirements cause an oversupply of parking by examining the implicit marginal value of land allocated to parking spaces. This is an indirect test of the effects of parking requirements that is similar to Glaeser and Gyourko (2003). A simple theoretical model shows that the marginal value of additional parking to the sale price should be equal to the cost of land plus the cost of parking construction. We estimate the marginal values of parking and lot area with spatial methods using a large data set from the Los Angeles area non-residential property sales and find that for most of the property types the marginal value of parking is significantly below that of the parcel area. This evidence supports the contention that minimum parking requirements significantly increase the amount of parcel area devoted to parking. Sandy Ikeda’s latest article at FEE’s “The Freeman” is a great summary of the libertarian sprawl debate. There has been a lot of Internet chatter lately about what libertarians ought to think about urban sprawl and its causes, including pieces by Kevin Carson, Austin Bramwell, Randal O’Toole, and Matthew Yglesias. The title of Ben Adler’s post basically sums it up: “If You Love the Free Market, You Should Hate Mandated Suburban Sprawl.” Sandy includes a mention of the ongoing minimum parking debate. Sandy concludes that the more the government subsidizes items related to low-density development, the more low-density development we’ll get. But the bottom line is that the law of demand still holds – other things equal, the cheaper you make something the more of it people will want to buy, and that includes low-density development. You’ll get more of that, too, if those direct and indirect subsidies make it cheaper for people to get it. Government intervention has done just that, and it’s hard to understand how you can argue, whether you’re a proponent or (especially) an opponent of Smart Growth, that the free market alone is responsible for the amount of sprawl that we actually have. This doesn’t mean, of course, that Smart Growth regulations are the place to begin. Instead, if you think sprawl is a bad thing, it would seem logical to first remove the vast array of interventions that over the decades have pushed it along. On this, I would have thought all market urbanists could agree. Well said!
At Streetsblog, Ryan Avent presented a scorching attack on the most notorious free-market impostor – Randal O’Toole: Taking Liberties With the Facts for his consistent hypocrisy: The Cato Institute’s Randal O’Toole gets under the skin of many of those interested in building a more rational and green metropolitan geography, but in many ways he’s an ideal opponent. It would be difficult to concoct more transparently foolish arguments than his. The man is an engine of self-parody. The requisite identification of “libertarian” contradictions: This is one thing I’ve never understood about the libertarian love affair with highways; they seem utterly blind to the fact that it has required and continues to require massive government action to build and maintain the road network. The interstate highway system is perhaps the single largest government intervention in the economy in the 20th century. Reading O’Toole you’d think it was a wonder of the free market. And with ease, Ryan points out the data needed to take O’Toole to task on his persistent assertion the “roads pay for themselves”: The source of his blindness on the issue seems to be due to his belief that roads pay for themselves, and that congestion exists only because governments shift gas tax revenue to pay for transit and other smart growth projects. Nothing could be farther from the truth. In the first place, gas tax revenue comes nowhere near paying for roads. Federal gasoline tax revenues cover barely half of the annual budget of the Federal Highway Administration. Add in diesel tax revenues and you’re still short. And that’s just the federal budget picture. In a post blogger Eric Orozco called, ‘forerunner candidate for “most incisive blog post” of the year,’ Daniel Nairn of Discovering Urbanism discussed the seemingly conflicted camps of libertarianism when it comes to Urbanism. His observations are based upon the comments in the Volokh article on planning and walkability linked in the previous post. Daniel (a non-libertarian) presents the opposing libertarian factions as The Wright Group, after Frank Lloyd Wright and his romanticism about individualistic prairie living and The Friedman Group, which “believes that the spatial distribution of development ought to be determined by a free market.” The Wright group seems to favor optimizing individual autonomy through spatial living arrangements even if doing so requires centralizing economic and political authority to some extent. The Friedman group seems to favor optimizing individual autonomy through market decisions even if doing so results in more people living in situations where full control over private property is compromised in some way. Daniel’s insightful choice of figureheads fascinates me from a philosophical point of view. Frank Lloyd Wright was hardly a libertarian, but had strong individualist tendencies, and is said to be the model for Howard Roark’s character in Ayn Rand’s The Fountainhead. Milton Friedman, a Nobel Laurette Economist, is probably one of the most famous figures of modern libertarian thought. Despite Friedman’s steadfast defense of liberty, he had favored government roads on occasion. I think most would agree that The Friedman Group, as Daniel describes it, is more closely aligned with the thesis of Market Urbanism and the ideas of emergent order of the land marketplace. Hayek or even Rothbard may also be considered appropriate, although less famous substitutes as figurehead. At Volokh, Ilya Somin discusses a recent piece in the American Prospect (also linked from here) that favors “New Urbanism” to prevent “unwalkable” sprawl. Somin favors “voting with your feet” as the preferred method of satisfying location preferences. Unfortunately, voting options have been whittled down through government interventions: To the extent that we do need to enable more people to live in densely populated urban areas, it’s far from clear that government planning is the best way to achieve that goal. We can better achieve the same objective by cutting back on planning rather than increasing it. In many large cities, the cost of housing is artificially inflated by restrictive zoning laws, which tends to price out the poor and some middle class people. In the suburbs, as Adler points out, zoning policies sometimes artificially decrease density, for example by forbidding "mixed use" neighborhoods where commercial and residential uses are in close proximity to each other. The ultimate question is whether we should trust deeper interventions into land use to fix the complete failure of past interventions. Long before “New Urbanism” was the progressive utopian ideal, sprawling, auto-friendly and trolley-free, single-family suburbs was their “American Dream”. But, progressives quickly forget their history when it turns out their past visions created something they are now supposed to hate: Like previous generations of planners, the new urbanists often ignore the diversity of human preferences. Some people do indeed like high-density "walkable" environments. Others prefer to have more space and more peace and quiet. Neither preference is inherently superior to the other. To paraphrase a popular liberal slogan, we should celebrate diversity, not seek to use urban planning to force everyone to live the same lifestyle whether they want to or not. I’ve been meaning to address the public education system’s complex role in land use patterns, and found that Murray Rothbard does a better job in his 1973 manifesto, For a New Liberty than I ever could. In summary, locally-funded public education is an engine of geographical segregation, which encourages flight from urban areas, and was a driving motivation for the popular acceptance of exclusionary zoning in newer suburbs. As a result, wealth is consistently concentrated geographically, and housing affordability is at odds with these restrictions of supply intended to exclude poorer people from draining the property tax base. Here’s a paragraph from the chapter on education: The geographical nature of the public school system has also led to a coerced pattern of residential segregation, in income and consequently in race, throughout the country and particularly in the suburbs. As everyone knows, the United States since World War II has seen an expansion of population, not in the inner central cities, but in the surrounding suburban areas. As new and younger families have moved to the suburbs, by far the largest and growing burden of local budgets has been to pay for the public schools, which have to accommodate a young population with a relatively high proportion of children per capita. These schools invariably have been financed from growing property taxation, which largely falls on the suburban residences. This means that the wealthier the suburban family, and the more expensive its home, the greater will be its tax contribution for the local school. Hence, as [p. 133] the burden of school taxes increases steadily, the suburbanites try desperately to encourage an inflow of wealthy residents and expensive homes, and to discourage an inflow of poorer citizens. Chris Bradford over at Austin Contrarian has been making some solid points in favor of congestion pricing. (here, here, here and here) Chris’s core argument in favor of congestion tolling is that: congestion pricing does more than relieve congestion. Congestion pricing tells us when a road needs more capacity. Additional capacity costs money, and drivers are willing to pay only so much for it. That “so much” is exactly equal to the price they are willing to pay to avoid congestion. The idea that toll profits send a signal to road operators to produce additional capacity is often neglected in discussions of the benefits of congestion pricing. Without pricing, the only signal is the manifestation of congestion itself. This is problematic, as the only solution is to build more roads when congestion is observed. Actually if done right, years before congestion occurs with the help of foresight and luck on the part of transportation planners and agencies. This problem feeds the dangerous new highway –> sprawl –> congestion –> highway expansion –> sprawl, etc., etc. positive feedback loop. This feedback loop is quite a powerful mechanism that helps drive the unhealthy types of sprawl. Chris is on the right track, but sets a sub-ideal objective (in my opinion) when he says: The optimal congestion toll should be set just high enough to achieve free-flow (45 mph) traffic. Since the goal should not only be to avoid congestion, but to get the highest number of commuters through the system as possible, I would restate that as: The optimal congestion toll should be set at exactly the price that maximizes traffic flow.
